This matter is heard for some time and after considering the entire submissions of the learned advocates for the respective sides, there was a consensus that the directions in clause "B" issued by the Appellate Court vide judgment dated 05.02.2019 in Miscellaneous Civil Appeal No.53/2017 and clause "3" of the order dated 28.08.2017 passed by the Trial Court below exhibits 5 and 18 in RCS No.851/2016, would be maintained and respected and at the same time, the respondent/ original plaintiff shall also refrain from interfering with the peaceful possession of the property presently held by the petitioner. In the light of the above statements, this Writ Petition is disposed off. The Trial Court would decide RCS No.851/2016 as expeditiously as possible and preferably on or before 30.06.2020. kps (RAVINDRA V. GHUGE, J.)
