The petitioner claims his right pursuant to the sale deed and seeks directions against respondent nos.2 and 3 to make payment of compensation of Gut No. 46 to the extent of 28 Are of village Malhiwra [Taluka : Georai, District : Beed].

The learned Asst. Government Pleader submits that the name of the petitioner did not appear in Section 4 notification. Award is passed in the names of Shobha Hatmode and Mahadeo Hatmode. 3.

2/3rd advance compensation is also paid to the erstwhile owners i.e. Shobha Hatmode and Mahadeo Hatmode. If the petitioner wants compensation and if he is entitled to, he may claim from those who have been paid compensation amount or he may take up appropriate proceedings as would be permissible in law.

With the above observations, the Writ Petition is disposed of. No costs.
