Heard learned counsel for the applicants and learned APP for the State.

The applicants are seeking bail in Crime No.289 of 2021 registered with Jafrabad Police Station, District Jalna for the offence punishable under Section 394, 395, 411 and 201 of Indian Penal Code.

The applicants have been arrested. Nothing is recovered from them. They are languishing in jail since 17.01.2023. Some accused are still absconding. Considering the progress in the investigation, it would be inappropriate to keep the applicants behind bar. However, certain conditions may be imposed. Hence, the following order :

ORDER

(i) Bail Application is allowed.

935-ba-649-2023.odt (2) (ii) The applicants, Raju Anna Shinde and Sunil @ Fulchand Saheba Pawar, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) each with one solvent surety in the like amount in connection with the above crime, on the conditions that they shall not tamper with the prosecution witnesses. (iii) The applicants shall attend the concerned police station on every Monday, Wednesday and Friday between 06.00 pm to 09.00 pm, till filing the charge sheet.
