We have heard the learned counsel for petitioners, learned counsel for respondent Nos.2 and 3 and the learned AGP. Affidavit in reply is filed by respondent Nos.2 and 3. Paragraph 10 of the affidavit reads thus:
"10.
That, therefore it is the humble submission of the present respondents that in case the deficiencies will be cured by the respective petitioners/Grampanchayat, the said proposals shall be considered by the respondent authority according to Law. Therefore, by considering by above mentioned facts, submitted by the present respondent, the present petition may please be disposed off by giving the directions to the
1027 wp.6615.21.odt petitioners to comply with the deficiencies, post which just and proper actions can be given by this respondent."
It appears that if the deficiencies are cured by the respective petitioners / Grampanchayat, the said proposals shall be considered by respondent Nos.2 and 3 authorities.
Mr. Thombre, learned counsel submits that in fact the proposals were complete in all respects. However, the petitioners would further give the details and clear the deficiencies, if any. In view of that, the petitioners may comply the deficiencies, if any, and submit afresh. The same may be considered by respondent Nos.2 and 3 as per the affidavit submitted by it on its own merits, preferably within three months from the date of receipt of the clarification / compliance of deficiencies.
The writ petition is disposed of. No costs.
