Both the sides are heard. This Court has seen carefully the papers of investigation. One person died and two persons became blind by consuming illicit liquor. The investigation is not yet completed. When this Court expressed that this Court is not inclined to grant relief, learned Counsel for the applicant, on instructions, submits that he wants to withdraw the proceeding with liberty to prefer the application after filing of the charge-sheet.

The Criminal Application is disposed of as withdrawn with aforesaid liberty.

During the arguments, it transpired that in the

( 2 ) cria1906.17 campus of Civil hospital the illicit liquor was being manufactured. From there the illicit liquor was collected and used in election campaign and sold to others and due to which many persons died. There is regular police station also in the said campus. The investigation needs to be made to find out how police could not get clue of such activity in the campus of Civil hospital. 4.

Copy of this order be sent by learned Registrar (Judicial) of this Court to the Superintendent of Police, Ahmednagar.
