It appears that the proposal is not submitted to the Education Officer seeking approval to the transfer of the petitioner from unaided to aided post. The proposal has to move from the Headmaster accompanied with all the necessary documents. In the present case, only the application has been given by the petitioner to the Education Officer seeking approval on the aided post. The Education Officer does not have power to transfer an employer in a private school from unaided to aided post. It is only the Management that has power to transfer the employee from unaided to aided post resorting to Rule 41 of the MEPS Rules.

The petitioner may make application to the institution for his transfer from unaided to aided post, of course if the petitioner satisfies
