The petitioners who is the original complainant, is awaiting decision of the State Government in the statutory appeal preferred against the order of the Divisional Commissioner passed under Section 39 of the Maharashtra Village Panchayats Act, 1859 dated 03.09.2024 and pending with the learned Minister, since 27.09.2024.

Considering the fact that the election was conducted in the year 2022 and almost three years have already lapsed, since
(( 2 )) 55-WP-5226-2025 it is a matter of disqualification of an elected Sarpanch for the alleged misdeeds, the writ petition is disposed of with a direction to the respondents to decide petitioners' appeal as expeditiously as possible and in any case within three months.
