The petitioner has been disqualified for not being able to produce Caste Validity Certificate as contemplated under Section 10-1A of the Maharashtra Village Panchayats Act, 1959. 2.

The learned advocate Mr. Chaudhari for the petitioner would vehemently submits that though he made a genuine attempt to obtain the Caste Validity Certificate by approaching the Scrutiny Committee, at every stage the original complainant who is respondent No.5 herein had obstructed that proceeding and did not allow the Scrutiny Committee to decide the issue. No fault can be found with the petitioner in not being able to obtain the Caste Validity Certificate in time when the respondent No.5 was responsible for the delay.

Admittedly, he ought to have produced the Caste Validity Certificate by 28.09.2019. For whatever reason he could have it on 23.03.2022.

In view of such admitted state of affairs, regarding failure of the petitioner to file the Caste Validity Certificate within stipulated and statutory time, he has been disqualified. There is no apparent error or illegality in the order passed by the authorities.

The Writ Petition is dismissed.
