Learned counsel for the petitioner had sought time to have instructions as regards withdrawal of the Writ Petition. Learned counsel, on instructions, submitted for passing necessary orders.

It is reiterated that, the petition has been filed for quashing of the proceedings initiated under Section 12 of the Protection of Women from Domestic Violence Act, 2005. The petitioner the husband. Respondent is his wife. She has initiated the impugned proceedings way back in May 2019.

Criminal W.P. No.520/2021 :: 2 ::

The present petition has been filed about two years thereafter. Meanwhile, the Court seized of the matter has passed order directing the petitioner to pay the respondent interim maintenance. Moreover, recording of evidence in the matter has commenced. As such, it is even not a fit case to issue notice to the respondent.

In the facts and circumstances stated hereinabove, the petition is liable to be dismissed. The petition is, therefore, dismissed.
