Per Court :- Present Criminal Application is filed by Applicants for grant of anticipatory bail, since they are apprehending their arrest in connection with CR No. I 43/2015 registered with Police Station, Washi, Taluka - Washi, District - Osmanabad for the offences punishable under Section.s. 307, 326, 143, 144, 145, 146, 147, 148, 149 of the Indian Penal Code. [2] Heard Mr. V.D. Salunke, learned counsel for the Applicants and Mrs. V.A. Shinde, learned Additional Public Prosecutor for the State. [3] Investigating Officer - Sheshrao Pandurang Pawar, Assistant Police Inspector, Police Station, Washi, Taluka - Washi has filed his affidavit in reply. Same is taken on record. Affidavit in reply of the Investigating Officer shows that, even according to the Investigating Officer
2/3 during the course of investigation, no specific role is attributed to Applicant Nos. 2 and 3. In that view of the matter, their application is to be considered favourably.
[4] In so far as Applicant No.1 is concerned, role attributed to him is that he caught hold the injured Mahesh, who was assaulted by Meghraj Jaysing Deshmukh. It is reported to the court by the learned Additional Public Prosecutor that, Meghraj is already arrested by the Investigating Officer and his bail application is already rejected by the learned trial court. [5] Looking to the reply and looking to the role attributed to Applicant No.1, application is required to be allowed. Hence, I pass the following order :-
ORDER
(i) Criminal Application is allowed.
(ii) In the event of arrest, Applicant No.1 - Pratap Vilasrao Deshmukh, Applicant No.2 - Sayajirao Vinayakrao Deshmukh and Applicant No.3 - Sunil Popatrao Deshmukh shall be released on anticipatory bail on they executing P.R. Bond of Rs. 5,000/- [Rs. Five Thousand.] each with one solvent surety in the like amount, in connection with CR No. I 43/2015 registered with Police Station, Washi, Taluka - Washi, District - Osmanabad for the offences punishable under Section.s. 307, 326, 143, 144, 145, 146, 147, 148, 149 of the Indian Penal Code.
3/3 (iv) With this Criminal Application is allowed and same is disposed of accordingly.
