Heard. The report of mediation indicates the matter to have been settled. The parties have agreed to part ways. As per the terms of the settlement, the husband has agreed to pay the respondent No.2 - wife a sum of Rs.6 Lakhs towards full and final settlement for her claim towards maintenance and gold ornaments etc. Even the application preferred under Section 12 of the

Cri.Appln.No.1453/2022 :: 2 ::

Protection of Women from Domestic Violence Act is agreed to be withdrawn. In view of the above, the application is allowed in terms of prayer clause (B).

The Family Court is expected to decide the application under Section 13(1)(B) of the Hindu Marriage Act at the earliest. The applicants have deposited a sum of Rs.6 Lakhs, to be paid to the respondent No.2 - wife. Since the marriage petition has yet not been finally disposed of, out of the sum deposited in this Court, a sum of Rs.5 Lakhs be paid to the respondent No.2 - wife immediately.
