Heard learned Advocate Mr. Joslen A. Menezes h/f Advocate Mr. P.S. Paranjape for the applicant. 2.

Upon queries he submits that the applicant has not filed any review application for the review of order dated 04.09.2023. He then submits that he be allowed to withdraw the application with liberty to file an application for the review of the order dated 04.09.2023 and also to grant liberty to take further steps in case of review of the said order.

At the outset we would say that we cannot go on anticipating that the review of the order dated 04.09.2023 would be allowed in favour of applicant. The order that was sought to be reviewed in the present matter i.e. order dated 26.02.2024 was infact based on the order that was passed by this Court earlier i.e. on 04.09.2023. Now the applicant wants to file an application for review of the said order dated 04.09.2023. If such right is there then the applicant may exhaust the same. Liberty is granted to withdraw this application, however, no further liberty is given because anticipation is not allowed.
