This matter was heard for some time on 24th April, 2023. Since Shri Dande, the learned Advocate is on the panel of the MIDC, we requested him to assist the Court. On his request, we adjourned the matter to enable him to take the instructions. 2.
Heard the learned Advocates and perused the Writ Petition paper book.

It is undisputed that the last candidate from the select list, who belongs to VJ(A) category, has not joined on the post of Senior Accountant. The Petitioner is at serial No.1 in the waiting list and he also belongs to the same VJ(A) category. If the candidate belonging to
903 WP.4394.23.odt the same category has not joined and the post is not filled in, the MIDC will have to open the wait list and take the first ranking candidate, who belongs to the same reservation category. Co-incidentally, the Petitioner is at serial No.1 in the waiting list and belongs to the same reservation category.

The learned Advocate for the MIDC submits that the issue would be considered and a decision would be taken within a time frame, as this Court may direct.

In view of the above, this Petition is disposed off. 6.
We expect Respondent No.2 to take a decision, in the light of the grievance voiced by the Petitioner in this Petition, considering the Government Resolutions/ Policies as may be applicable, and in the light of the above observations, preferably within a period of 30 days from today.
