The Applicant in the present criminal application is praying for transfer of the proceedings bearing SCC No.405 of 2022 and Criminal M.A. No.129 of 2022, arising out of R.C.C. No.251 of 2022, presently pending before the learned Judicial Magistrate, First Class, Phulambri, to the Court of learned J.M.F.C., Shevgaon. 3.
Learned Advocate for Respondent Nos.2 to 6 submits that the Applicant is the wife of Respondent No.2, while Respondent Nos.3 to 5 are her in-laws. The marriage between the Applicant and Respondent
2 of 3 920-APPLN.1617.2024 No.2 was solemnized on 18th April 2017. Out of the said wedlock, they have two daughters, who are presently residing with Respondent No.2husband. It is the case of the Applicant that, as the proceedings are pending before the J.M.F.C., Phulambri, she is required to travel from Shevgaon to Phulambri. Since her residence has now shifted to Shevgaon, she seeks transfer of the said proceedings to the Court at Shevgaon for convenience.

Learned Advocate for Respondent Nos.2 to 6 further submits that Respondent Nos.3, 4, and 6 are aged persons and it would be difficult for them to attend Court proceedings at Shevgaon. However, the inconvenience regarding their attendance can be addressed by filing appropriate applications seeking exemption from personal appearance before the concerned Court.

Considering that the Applicant is now residing at Shevgaon and the proceedings are pending at Phulambri, I am inclined to allow the prayer for transfer. Accordingly, the proceedings pending before the learned J.M.F.C., Phulambri are hereby transferred to the learned J.M.F.C., Shevgaon, District Ahmednagar.

The application is accordingly allowed in terms of prayer clause (b).

The learned J.M.F.C., Shevgaon, is directed to decide the said matters expeditiously. The learned Magistrate shall also consider any application for exemption from personal appearance filed by the aged Respondents sympathetically.
