Present application is moved for regular bail since the applicants are arrested in connection with Crime No. 39/2015 registered with police station Sillegaon, Dist. Aurangabad for the offence punishable u/s 302,323,504,506, 143,147,149 read with 34 of the Indian Penal Code. 2.

Heard Mr. Sachin S.Shinde, learned Counsel for the applicants and Mrs. V.A.Shinde, learned A.P.P. for respondent - State.

Though the investigation is in progress, from the

2 Cr.Apln. 2167.2015 F.I.R. which was lodged by Premsingh, son of deceased Gangabai, shows that the role of present applicants is only of holding hair of Pooja, wife of first informant, and giving fist blows to her. The role of administering poisonous substance is against Charansingh and others. Learned A.P.P., on the basis of investigation papers, submits that except aforesaid accusations there is no material against present applicants. 4.

Looking to the nature of accusations made against present applicants, who are ladies, and since the applicants are in jail since 07/04/2015, their further custodial presence is not necessary.

Hence, I pass the following order :

(i) Present Criminal Application is hereby allowed.

(ii) Applicant No. 1 Kasturabai w/0 Fulsingh Jarwal and applicant No. 2 Chayabai w/o Charansingh Naglot be released on bail in connection with Crime No. 39/2015 registered with police station Sillegaon, Dist. Aurangabad for the offence punishable u/s 302,323,504,506, 143,147,149 read with 34 of the Indian Penal Code on they executing P.R.Bond of Rs. 5,000/- [Rupees Five Thousand] with one solvent surety of like amount by each of them. Bail before the trial Court.
