ORAL ORDER :

Heard the counsel appearing for the petitioner and learned A.P.P. for the State. In the order passed by this Court while deciding Criminal Writ Petition No.211/2014, dated 21.7.2014 in the similar set of facts, directions are issued to the respondents to consider the prayer of the petitioner therein. Similar directions may be issued in the present case also since the subject matter of the present petition is also like the subject

Criminal W.P. No.568/2015 matter of Criminal Writ Petition No.211/2014. 2.

In the circumstances, we direct the respondents to consider the prayer of the petitioner in the light of notification dated 23.4.2012 issued by the Department of Home and the judgment of this Court at Principal Seat at Bombay in Criminal Writ Petition No.1485/2013 [Jagannath Raghunath Shelke vs. The State of Maharashtra & ors.] within three weeks from today and report compliance to the office of the Public Prosecutor, High Court of Bombay, Bench at Aurangabad. The petition is disposed of in above terms.
