IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
BENCH AT AURANGABAD.
118 WRIT PETITION NO.4659 OF 2023 VIVEK SANTOSH SURYAWANSHI
VERSUS
THE STATE OF MAHARASHTRA, THROUGH THE SECRETARY AND OTHERS ...
Advocate for Petitioner : Mr. Mangesh G. Patil. AGP for Respondent/State : Mr. V. M. Kagne.
...
CORAM :
RAVINDRA V. GHUGE & SANJAY A. DESHMUKH, JJ.
DATE :
25th April, 2023.
Per Court:
1.
The Petitioner's father passed away on 1st August, 2021. He was working as a Senior Clerk with Sarvajanik Vidyalaya Sarabate since 17th February, 1999. The Petitioner widow applied for compassionate appointment on 13th June, 1990. The only grievance put forth is that the application is pending and the management is not responding.
2.
Considering the prayers, we are of the view that this Petition need not be kept pending. The management could be called upon to deal with the said representation since the Honourable Supreme Court has now laid down the law that an application for compassionate appointment should be decided and taken to it's logical end, within 6 months.
118 WP.4659.2023.odt 3.
This Petition is, therefore, disposed off with a direction to Respondent No.4 to deal with the representation of the Petitioner, dated 28th September, 2021 and respond to the same within a period of 45 days. A communication as regards the decision taken, be served upon the Petitioner within 15 days from the date of such decision. 4.
We make it clear that we have not expressed any view on the merits of the application of the Petitioner. 5.
The Petitioner would serve a copy of this order on Respondent No.4, expeditiously.
