Heard the learned counsel for the applicant and the learned A.P.P. for the respondents.

The applicant seeks bail in C.R.No.508 of 2019 registered with CIDCO Police Station, District Aurangabad, for the offences punishable under Section 302 of the Indian Penal Code, on the ground of inordinate delay in concluding the trial. However, the learned A.P.P. submits that till date fourteen witnesses have been examined and only two witnesses remained to be examined. Therefore, trial may be concluded within three months. 3.

Considering the serious allegations against the applicant and assurance given by the prosecution, an opportunity may be granted to the prosecution. However, instead of three months, the

912-BA-671-24.odt Court grants two months to the prosecution to examine the witnesses and co-operate with the Court to get the matter decided within two months from today.

If any party or the prosecution does not co-operate with the trial Court, the trial Court should record the observations below Exhibit-1 noting the conduct of the respective parties which may entail to decide bail application, if any, filed in the event of not concluding the trial as above.
