The petitioner who is husband of respondent no.1 is challenging the order passed by the lower court in a proceeding initiated by him under the Hindu Marriage Act, 1955, directing him to pay her Rs.3,000/- per month as an interim alimony.

Admittedly, the couple has two children, aged 8 and 2 years, who are being maintained by the respondent no.1 wife. 3.

Though she is in the employment of police department, as has been rightly pointed out by the learned Judge, being a father the petitioner also is expected to share the burden for bringing up the children. 4.

Admittedly, the petitioner has been earning a net salary of 1/2

Though it was an application seeking maintenance for all the respondents, namely, wife and their two children, the lower court has merely allowed the application party and directed the petitioner to pay Rs.3,000/- per month to the respondent no.1 wife by taking into account the fact that she has been maintaining the children.

There is no illegality in order passed by lower court, the writ petition is dismissed.
