Mr. Dhage, the learned counsel for petitioners submits that, the respondent No. 5 be directed to take steps on the application filed by the petitioners and follow the directions issued by the respondent No. 2 to mark the Shiv rasta of village Nanded as per the sanctioned development Plan in the year, 2002. According to the learned counsel, the respondents are not taking any further steps. The petitioners have time and again given application for the same.

The learned counsel for the Municipal Corporation i. e. the respondent No. 5 submits that, the petitioners are intimated vide intimation dated 24.07.2015 that in the sanctioned development plan, 15 meter wide development road is proposed and is shown as 15 meter wide road. The same is up to Nagpur road and in future the road is proposed on the said site. It is also stated that, different applications received are directed to be considered by the Assistant Commissioner (Unauthorized Constructions and

2 wp 5953.15 Encroachments Department), of the Corporation, they would take necessary action.

In light of that, the purpose of the writ petition to a certain extent stands redressed.

The Assistant Commissioner (Unauthorized Constructions and Encroachments Department), so also, the Executive Engineer (Public Works Department) may take further action on the applications and the complaints as is stated in the letter dated 24.07.2015.
