The Writ Petition was dismissed in default on a lodging Stamp Number. It was at a pre-notice stage. 2.

Heard the learned Advocates for the respective sides. Considering that no notice was issued in the Writ Petition, that we are entertaining this Civil Application.

The learned Advocate for the Petitioner makes a solemn statement that the Petitioner desires to withdraw this Petition in view of

- 2 - the modalities available in the GR dated 14.12.2022. 4.

In view of the peculiar facts as recorded above, the Civil Application is allowed. The delay of 763 days is condoned on the condition that the Applicant would remove all office objections. 5.

The learned Advocate for the Petitioner submits that most of the objections are with regard to the original record. Now that the Petitioner prays for leave to withdraw the Petition, the Petitioner prays that the Writ Petition be considered today for withdrawal. 6.

It is in the peculiar facts as above that, we grant leave to the Petitioner to remove the illegible papers from the Writ Petition paper book. The Writ Petition is restored.

In view of the above and by consent of the parties, the Writ Petition is taken up. The learned Advocate for the Petitioner submits that the Petitioner desires to withdraw this Petition and avail of the benefit of the GR dated 14.12.2022.

In view of the above statements, the Writ Petition is disposed off, as withdrawn on instructions.
