After arguing the civil revision application for some time, learned counsel for the applicants, on instructions, state that he will not press civil revision application, however the applicants may be granted liberty to take out appropriate application for framing preliminary issue under Order XIV Rule 1 of the Code of Civil Procedure, 1908 ("CPC").

The impugned order is only with respect to the decision on application under Order VII Rule 11 of CPC, hence liberty as prayed for can be granted. The applicants are at liberty to raise 1/2
