Heard Shri Kale, learned counsel for the Applicant / Claimant and Shri Dande, learned counsel for the acquiring body. The Applicant i.e. original Claimant is permitted to withdraw 50% of the deposited amount on furnishing an undertaking that in the event any adverse order is passed against him, he will redeposit the amount so withdrawn by him within four months from the date of passing of such order. The Applicant is permitted to withdraw the remaining 50% of the deposited amount on furnishing solvent surety in the like amount or the bank guarantee in the like amount of any nationalized bank or scheduled bank.
