The petitioner is the original plaintiff. The Writ Petition challenges the order recalling the petitioner-plaintiff for his further cross-examination. However, inadvertently, the petitioner-plaintiff has not challenged the basic order of recasting of the issues. Thus, the Civil Application is filed for permission to amend the petition for challenging the said order of recasting the said issue.

In view of the same and for the reasons stated in the application, civil application is allowed in terms of prayer
