No doubt, the Petitioner's original proposal for validation of his claim of belonging to the "Thakur", Scheduled Tribe category tendered in 2006, was turned down because there was a "Hindu Thakur" entry in his certificate. After obtaining the corrected certificate, the proposal is now tendered in June, 2022. The vigilance cell enquiry is said to be completed. This statement is contradicted by the Committee. The Petitioner is in employment with the Post Office.

In view of the above, this Writ Petition is disposed

*2* 58wp4429o23 off with the following directions:- (a) The Committee shall decide the claim of the Petitioner by 31.12.2023.

(b) The Petitioner would render wholehearted cooperation for the expeditious disposal of the claim and would refrain from seeking adjournments on unreasonable or trivial grounds, lest the Committee would be justified in progressing to the next stage in the proceeding.

(c) The Respondent Employer would not terminate the services of the Petitioner till 31.12.2023, or till the claim of the Petitioner is decided, whichever is earlier.

(d) In case, the Committee's conclusion is adverse to the Petitioner, the same shall not be effective until 15 days from the date of the order in order to enable the Petitioner to avail the legal remedies as may be permissible in law.
