Learned Counsel appearing on behalf of the applicant, upon instructions, submits that the applicant-accused is tried for the offences punishable under Sections 302, 307, 342 read with Section 34 of the Indian Penal Code, is consistently attending the proceedings in Sessions Case No. 191 of 2008, pending before the learned Sessions Judge, Aurangabad.

He then undertakes that the applicant shall not seek any exemption or prolong the trial and shall co-operate the learned Court below in getting decide the Sessions trial, which is more than five years old. 3.
In view of above undertakings, the present application stands
criap2189.16 (2) allowed. The present applicant be released on regular bail on same terms, as were imposed by the learned Court below, while granting bail. 4.
If the applicant fails to co-operate with the learned Court below or dishonour the undertakings referred above, the Sessions Judge will be at liberty to cancel his bail.

The applicant shall pay cost of Rs. 5,000/- to the Library, Advocates Association of Bombay High Court, Bench at Aurangabad, within period of one week from today.
