None appeared for the petitioner on 28th February 2020. Today also in the morning session, there was no appearance on behalf of the petitioner, the matter was kept back. In the afternoon session, again none appeared for the petitioner.

The Public Interest Litigation praying that the directions be given to the respondent No.1 to conduct enquiry by appointing Special Investigating Team, in respect of overhead water tanks and booster pumps and

( 2 ) pil47.13 other civil works executed in the area of Pensionpura and Gawalipura and wards of Cantonment Board, Aurangabad, is pending since 2013.

Since 2016 there is no effective hearing in the matter and the record shows that the petitioner had not been vigilant in prosecuting the cause. We see no reason to keep this Public Interest Litigation pending. It is dismissed. In the circumstances, the parties to bear their own costs.

In view of disposal of the Public Interest Litigation, Civil Application No.9881 of 2015, for intervention is disposed.
