Heard both learned Counsel appearing for the parties.

By order dated 15th June, 2018, the matter

(2) was referred to learned Mediator, as the parties expressed their willingness to explore the possibilities of an amicable settlement through mediation process. Today, the report of learned Mediator is also placed on record. The perusal of report shows that the parties have settled their dispute amicably with the intervention of learned Mediator. The terms are settled between the parties. The terms between the parties settled by them are duly signed by the parties and their respective Counsel.

As per clause-3 of the terms of settlement, the appellant was to hand over demand draft of Rs.6,00,000/- (Rs. Six lacs only) drawn in favour of respondent Amruta d/o Bhanudas Jagdhane. Today, the said demand draft is also handed over to the respondent. The respondent agreed to withdraw the proceedings. The parties have agreed to withdraw two proceedings filed before learned Principal Family Court at Aurangabad being E-Petition No.30 of 2018 and E-Petition No.A-106 of

(3) 2018 (Counsel submits that in the terms of settlement, inadvertently by typographical error number of the proceedings is shown as A-6 of 2018 and it is A-106 of 2018). The parties by the terms of settlement, agreed to part their ways and break up matrimonial tie between them. The parties have also stated in the terms of agreement that apart from these proceedings, if any other proceeding is pending against each other, they will withdraw that proceeding also.

In view of the terms settled between the parties, agreed by them, the appeal is disposed of accordingly.
