BA607.22 (1)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 905 BAIL APPLICATION NO.607 OF 2022 SACHIN TATERAO KHANDAGALE
VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER Mr. N.S. Kadarle, Advocate for applicant;
Mr. V.S. Badakh, A.P.P. for respondent CORAM : S. G. MEHARE, J.
DATE : 15th June, 2022 P.C.
1.
Learned Counsel for the applicant is permitted to place the service affidavit on record.
2.
Learned Counsel for the applicant submits that the applicant was released on anticipatory bail, however, he could not remain present on the date of the hearing. Therefore, non bailable warrant was issued against him by the Special Court. He had applied for cancellation of the non bailable warrant. However, the said application was also turned down by the Special Court and the applicant was taken in custody. He also submitted that thereafter a fresh bail application was also filed. The said bail application has also been rejected by the Special Court. Thus, the applicant
BA607.22 (2) approached this Court for grant of bail.
3.
Learned Counsel for the applicant has categorically stated that the Special Court has not cancelled the earlier bail granted in favour of the applicant.
4.
In the aforesaid situation, it would be difficult to entertain the present bail application. There cannot be two bail orders in the same crime in favour of one and the same applicant. 5.
At this stage, the learned Counsel for the applicant submits that the applicant wants to take appropriate steps to challenge the order dated 13.4.2022 passed by the learned Special Judge. In view thereof, the instant application stands disposed of. (S. G. MEHARE, J.) amj
