This civil application is preferred for withdrawal of the amount deposited by the Acquiring Body in this Court. 3.

The learned advocate for the Acquiring Body has strongly opposed the application.

In view of the fact that the application is preferred by the original claimant, whose land is acquired, this Court is inclined to allow the application. Hence, the applicant is permitted to withdraw 50% of the total amount deposited by the Acquiring Body along with the accrued interest subject to furnishing an undertaking that in case, the appeal is allowed, the applicant shall redeposit the amount along with interest within twelve weeks thereafter.
