9681.21wp (1)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 902 WRIT PETITION NO.9681 OF 2021 AMBADAS TRIMBAK GADEKAR
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Mr P. S. Patil, A.G.P. for respondent Nos.1 to 5 CORAM : RAVINDRA V. GHUGE AND S. G. DIGE, JJ.
DATE : 30th March, 2022 PER COURT:
1.
None was present for the petitioner when this matter was called out yesterday. We posted the matter today on the daily cause list under the caption of 'passing dismissal order'. 2.
Yet, none appears for the petitioner.
3.
With the assistance of the learned AGP, we have gone through the petition paper book. It is pointed out that the learned Civil Judge Junior Division, Jafrabad has delivered an order dated 21/05/2020 by way of an ad interim protection under Exh.5 in Regular Civil Suit No.51/2020. Based on the said protection granted to the original plaintiff and the ad interim injunction
9681.21wp (2) restraining the petitioner/defendant, that police protection was granted to the plaintiff.
4.
Considering the above, we find that a dispute of civil nature is brought before us in extra-ordinary powers under Article 226 of the Constitution of India. We decline to issue a writ in such matters.
5.
In view of the above, this petition is dismissed. (S. G. DIGE, J.) (RAVINDRA V. GHUGE, J.) sjk
