Mr. Majit S. Shaikh, learned counsel submits that he has instructions to appear on behalf of respondent No.1. Heard the learned counsel for the applicant and the learned counsel for respondent No.1.

This is an application for condonation of delay of 62 days caused in filing the first appeal.

The learned counsel for respondent No.1 strongly opposed the application and submitted that there is no sufficient reason to condone the delay.

On perusal of the application, it appears that the delay has not

13 ca.4608.25.odt been deliberately caused. Therefore, in the interest of justice, the delay deserves to be condoned.

For the reasons stated in the application, the delay stands condoned. The application stands allowed in the interest of justice. The appeal be registered.

Appeal:

Issue notice to the respondents for final disposal, returnable on 15th December, 2025. Mr. Majit S. Shaikh, learned counsel waives notice on behalf of respondent No.1.

List the appeal for final disposal at admission stage on next date. In addition to regular mode of service, private service, as is permissible in law, is permitted.
