This is an Application for condonation of 1281 days delay caused in preferring the First Appeal against the Judgment and Award passed by the Reference Court in the Land Acquisition Proceedings. 2.

Learned Advocate for the Applicant submits that the Applicant being financially poor was unable to approach this Court within the stipulated period and hence, the Application be allowed. 3.

Learned AGP, who appears for Respondent Nos. 1 and 2, opposes the Application. He submits that sufficient reasons are not shown in the Application. He submits that, in the event this Court allows the Appeal, the Applicant shall not be entitled for the interest and the statutory benefit for the delayed period. SG Punde

On hearing both sides and after going through the Application, the Application is allowed in terms of prayer clause ' B' for the reasons mentioned in paragraph nos. 3, 4 and 5 of the Application, on the condition that the Applicant shall not be entitled for the interest and the statutory benefit for the delayed period. Keep the copy of this order in the order sheet of Appeal.
