It is an application for condonation of delay moved by the applicants/appellants. It seems that there is delay of 1323 days in preferring the appeal.

Heard Mr. Munde, learned counsel for applicants. Respondent though duly served, remained absent when the matter is called out.

For the reasons stated in the application, more particularly paragraph 5 and looking to the points involved in the appeal, the delay needs to be condoned.

Mr. Munde, learned counsel for applicant also seeks extension of time to comply the conditional stay order passed earlier by this Court.

It is necessary to extend the time by eight weeks to comply the order. Hence, the following order is passed:

O R D E R

I.

The application for condonation of delay is hereby allowed in terms of prayer clause (B). II.

The Registry to make scrutiny of the appeal as per the procedure and it be numbered and place before the Court for admission.

III.

The civil application for condonation of delay is accordingly disposed of.

IV.

Eight weeks time is hereby extended to comply the conditional stay order passed earlier by this Court dated 20th October, 2021. The applicants to deposit 70% of the amount under the impugned award within eight weeks.

V.

Inform to the concerned Court accordingly.

VI.

Interim stay granted earlier by this Court to continue till the next date.

VII. Keep the application for stay on 28th February, 2022.
