The learned counsel for the petitioners submits that the application filed by the petitioners under Section 28-A of the Land Acquisition Act is pending since 17.10.2005 with respondent no.3, the same is not yet decided. 2.

The learned A.G.P. on instructions from respondent no.3 confirms about the pendency of the said proceeding.

Respondent no.3 shall decide the application filed by the petitioners under section 28-A of the land Acquisition Act on its own merits, in accordance with law and after hearing all the parties concerned, preferably within a period of nine (09) months.
