It is submitted that the petitioner is similarly situated as the petitioners in Writ Petition No.4616 of 2016 and other connected Writ Petition Nos decided under judgment dated 22.12.2017, Writ Petition Nos. 12198 of 2015 decided on 01.03.2018 and Writ Petition No.1689 of 2014 decided on 08.08.2018.

Learned counsel further submits that the petitioner is restricting his claim to the extent of recovery only.

For the reasons stated in the judgments, referred to supra, the impugned order, passed by respondent Nos. 2 and 3 to the extent of claiming recovery is quashed and set aside. If the recovery is made, the respondents shall pay the said amount within a period of six months.
