We have heard the learned Advocate for the Petitioner and the learned A.G.P.

The Executive Engineer, Construction Division, Zilla Parishad, Nandurbar has tendered a report to the District Collector, Nandurbar dated 21.02.2023. He has expressed an opinion that the project is a part of non planned road and it is much outside the village. No land of any farmer is affected and

(( 2 )) 24-WP-6171-2023 hence, there would be no reason to grant compensation. This opinion is still pending with the District Collector. 3.

In view of the above, this petition is disposed off. We expect the District Collector, Nandurbar, to take the issue, pertaining to the communication dated 21.02.2023, to a logical end within a period of ninety (90) days. In the event any stake holder is required to be heard, the principles laid down in law shall be followed while arriving at a decision.
