Mr. Paranjape, learned Counsel for the petitioners seeks liberty to file fresh suit in the matter of alleged encroachment pursuant to the report of T.I.L.R. for which measurement was carried out in 2011.

Learned Counsel for respondent has objected the said liberty on the ground that the claim is time barred. 3.

The writ petition stands disposed of in view of above prayer made by Mr. Paranjape with liberty as prayed for, subject to keeping the issue of limitation open.
