Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in C.R.No.0441 of 2022 registered with Paithan Police Station, District Aurangabad, for the offence punishable under Sections 302, 307, 324, 143, 144, 147, 148, 149 of the Indian Penal Code.

Perused the chargesheet.

The allegations against the applicant is that he assaulted with wooden log to the first informant Machindra Kharad on his legs and hands and also assaulted with one Jalindar Kharad. Both have suffered simple injuries. The deceased died of the head

934-BA-655-23.odt injury. There were cross reports against each other. Considering the role attributed to the applicant, the Court is of the view that his further detention would serve no purpose. He deserves bail on certain conditions. Hence, the order:- i) Bail application is allowed.

ii) Applicant Sambhaji s/o. Somnath Kharad be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.0441 of 2022 registered with Paithan Police Station, District Aurangabad, for the offence punishable under Sections 302, 307, 324, 143, 144, 147, 148, 149 of the Indian Penal Code, on the conditions that;

(a) He shall not tamper with the prosecution witnesses. (b) He shall not enter village Solnapur for three months from the date of his release.
