IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.8250 OF 2018 WITH CA/11339/2018 IN WP/8250/2018 WITH CA/13414/2018 IN WP/8250/2018 PARIMAL LALCHAND KHANDELWAL

VERSUS

MANAGER PANDIT DINDAYAL NAGARI SAHAKARI PATSANSTHA MARYADIT AHMEDNAGAR AND OTHERS ...

Advocate for Petitioners : Mr. Shinde Chandrakant K. Advocate for Respondent No.1 : Mr. N.V. Gaware AGP for Respondent N.3: Mr. S.W. Munde .....

CORAM : N. M. JAMDAR, J.

DATED : 4 DECEMBER 2018 PER COURT:- 1.

By this petition, the petitioner has challenged the order passed by the Divisional Joint Registrar, Co-operative Societies, Nashik, rejecting the stay application filed by the petitioner in the revision application.

2.

Te learned counsel for the respondent has drawn my attention to the prayers made in the revision application. Te prayer is that the order dated 5 October 2017 fixing the offset price be set aside. Te order dated 5 October 2017 is annexed to the petition. Tis order clearly states that the offset price under order will remain valid only for a period of six months.

wp8250.18 -23.

In view of this position, the order challenged in the revision, fixing the offset price being valid only for a period of six months, has lost its efficacy by efflux of time.

4.

Tis writ petition is pending in this court and ad-interim order has been granted. Since the main proceeding i.e. revision itself does not survive in view of the above position, it is not necessary to keep the writ petition pending. Te writ petition is accordingly disposed of.

5.

Needles to state that the ad-interim order is vacated. 6.

In view of disposal of main writ petition, pending civil applications do not survive and the same are disposed of accordingly. ( N. M. JAMDAR, J.) rlj/
