Shri Sai Samarth Sevabhavi Sanstha Aundha Naganath Thorugh Ts President Sanjay Shriharirao Chate v. The State Of Maharashtra Through Its Secretary And Others
(1) 913-wp-5314-2023
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.5314 OF 2023 SHRI SAI SAMARTH SEVABHAVI SANSTHA AUNDHA NAGANATH THORUGH TS PRESIDENT SANJAY SHRIHARIRAO CHATE
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...
Mr. J. M. Murkute, Advocate for the Petitioner. Mr. S. B. Pulkundwar, AGP for Respondents-State. ...
CORAM : MANGESH S. PATIL AND S. G. CHAPALGAONKAR, JJ.
DATE : 06th JUNE, 2023.
P.C:- 1.
Heard both the sides.
2.
Learned advocate for the petitioner submits that the petitioner-School is entitled to grant-in-aid, since it complies with all the parameters which are necessary for its entitlement. However the proposal is not being considered by the respondents. 3.
Learned A.G.P. submits that there seems to be a dispute between the petitioner and one more school in respect of transfer of the school.
4.
We need not go into the disputed question regarding transfer of school. If at all that has some bearing on the request being made by the petitioner for grant-in-aid, so be it. We are
(2) 913-wp-5314-2023 only concerned with the fact that respondent no.2-Deputy Director of Education is in receipt of the proposal and is supposed to forward it to respondent no.3. That is not being done. 5.
Keeping open all the issues and without expressing anything on merits including the entitlement of the petitioner to receive the grant-in-aid, we dispose of the writ petition by directing respondent no.2 to forward the petitioner's proposal to respondent no.3 as expeditiously as possible and the latter in turn shall forward it to respondent no.1-State, which shall consider the same and pass appropriate order as expeditiously as possible on its own merits.
(S. G. CHAPALGAONKAR) (MANGESH S. PATIL) JUDGE JUDGE Devendra/June-2023
