Per Court :- Present Criminal Application is filed by the Applicants for grant of anticipatory bail, since they are apprehending their arrest in connection with CR No.I 60/2015 registered with Police Station, Gangapur, Taluka - Gangapur, District - Aurangabad, for the offences punishable under Section.s. 395, 384, 341, 506 of the Indian Penal Code. [2] Heard Mr. V.D. Sapkal, learned counsel for the Applicants and Mrs. S.G. Chincholkar, learned Additional Public Prosecutor for the State of Maharashtra.

[3] Applicant No.1 is a teacher. Affidavit filed by Investigating Officer - Vijaykumar Pitambar Sonwane, Police Inspector, Police Station, Gangapur, District - Aurangabad shows that, in respect of incident dated 7th April, 2015 there are witnesses. It appears that present Crime is outcome of

2/3 dispute in between two groups of sand mafia. Court cannot keep blind eye, what is happening around the society. Stringent action is to be taken against the sand mafia.

[4] In that context, worth to note the past record of Applicant No.2. He is having two offences at his dis-credit. Investigation is in progress. Looking to the fact that Applicant No.1 is a teacher and there are no specific allegation against him, his application can be considered favourably. Hence, I pass the following order :-

ORDER

(i) Criminal Application is partly allowed.

(ii) Criminal Application filed by Applicant No.2 - Datta s/o Balasaheb Sarode is rejected and the interim protection granted in his favour vide order passed by this court dated 24th April, 2015 is stands vacated.

(iii) Criminal Application filed by Applicant No.1RAVINDRA S/O NIVRUTTI WALTURE is allowed. (iv) Applicant No.1 - RAVINDRA S/O NIVRUTTI WALTURE, in the event of arrest, shall be released on anticipatory bail on he executing P.R. Bond of Rs. 10,000/- [Rs. Ten Thousand.] with one solvent surety in the like amount, in connection with CR No.I 60/2015 registered with Police Station, Gangapur, Taluka - Gangapur, District - Aurangabad, for the offences punishable under Section.s. 395, 384, 341, 506 of the Indian Penal Code.
