After hearing learned counsel appearing for parties, one glaring thing emerges that while nomination had been filed it was not accompanied with copy of audit report being relied on, by the petitioner and the same came to be produced only during the course of hearing of the appeal. In such a case, no case is made out for entertaining writ petition.

Writ Petition, as such, stands rejected. However, it would be open for the petitioner to take up appropriate proceeding at proper stage including election petition.
