During the course of hearing, when the learned Counsel for the Respondent has raised objection with regard to the maintainability of the Application on the ground that the appropriate clause of the agreement has not been invoked by issuing notice under Section 21 read with 11 of the Arbitration and Conciliation Act. 2.

At this stage, learned Counsel for the Applicant, on instructions, seeks withdrawal of the Application with liberty to issue fresh notice and to initiate fresh proceeding under Section 11 of the Act. 3.

Hence, Application is dismissed as withdrawn with liberty as prayed.
