Heard learned counsel for the applicant.

According to the learned counsel for the applicant, the only changed circumstance since the date of disposal of earlier application is the filing of the chargesheet and certain statements of the witnesses which would show that the present applicant is not named.

The statements of those witnesses would, however, show that those eye witnesses have named the principal accused alongwith his friend. In that view of the matter, there is no change of circumstances. The application is, therefore, dismissed.
