Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers. 2.
Since the Applicant is apprehending arrest in Crime No. 0040 of 2025 registered with Mehunbare Police Station, District Jalgaon, for offences punishable under Sections 108, 351(2), 351(3), and 3(5) of the Bharatiya Nyaya Sanhita, 2023, he has approached this Court by filing the present Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for Anticipatory Bail.

It is the case of the Prosecution that the Deceased had given Rs. 3,00,000/- [Rupees Three Lakh] to Accused No. 2 - Sameer, as he
2 24ABA626.2025.odt and the present Applicant had asked him to make investment. The amount was invested for a period of six [6] months. After some days, the Accused No. 2 - Sameer, transferred Rs. 30,000/- [Rupees Thirty Thousand] online to the Informant, who is the brother of the Deceased. The remaining amount was not returned though the Deceased and the Informant requested the Accused No. 2 - Sameer. In September - 2024, when the Deceased and the Informant went to the house of Accused No. 2 - Sameer for demanding the remaining amount, the Accused No. 2 and his wife allegedly threatened them to implicate in the offence of rape. Subsequently, the Deceased went to the house situated in the agricultural field at Mehunbare and committed suicide by hanging himself from a hook attached to the ceiling on 09.10.2024. The Crime is registered on 23.02.2025.

Four (4) months prior, the Informant had given a statement in the same Police Station on 14.10.2024, that, his brother went into depression as he failed in three subjects of the 2nd year of B.Com. degree. The Informant later saw Instagram chats between the Deceased and the Applicant. The statements of two witnesses were recorded regarding these chat messages, which pertained to money. Accused No. 2-Sameer and Accused No. 4-Shivani have been granted regular bail by the Sessions Court, and the Accused No. 3 - Rahul and Accused No. 5 - Arun have been protected by this Court vide order dated 08.04.2025
3 24ABA626.2025.odt passed in Anticipatory Bail Application No. 511 of 2025. The Applicant was protected by an interim order dated 24.04.2025. Considering all these aspects and the nature of the offence, I am inclined to confirm the interim order/protection.
ORDER
[i] The interim protection/order dated 24th April, 2025 passed in the present Application, is confirmed.
[ii] The Application stands disposed off.
