The present Civil Application is preferred by the learned Advocate for the applicant to bring on record the legal representatives of original respondent No.5- Ashru Babu Bhole in Writ Petition No. 11816/2016, who expired on 10.02.2022. The applicant, in support of said contention, has filed the photocopy of death certificate of deceased Ashru Babu Bhole on record which is at (Exh. 'C-1'). On perusal of the death certificate, it is revealed that the original respondent No. 5/applicant expired on 10.02.2022 and the present Civil Application came to be moved on 20.04.2022, which is within limitation period.

Thus, considering the above facts and also by virtue of provisons under Chaper II Rule 3 Sub Rule (h)(i), the present Civil Application needs to be allowed and same is allowed, accordingly. Necessary amendment be carried out within two weeks from the date of this order.
