ORAL ORDER :- 1.

The petitioner has challenged the show cause notice dated 07.03.2012 issued by the Beed District Central Co-operative Bank Limited, Beed with regard to recovery of loan amounts.

Learned Counsel for respondent Nos.2 and 3 submits with regard to the recovery of the amount, that the petitioner has already submitted a reply to the impugned show cause notice. Thereafter respondent Nos.2 and 3 moved Dispute No. 371/2015 before the Co-operative Court and by judgment dated 06.02.2017, the dispute has been decided and the petitioner is directed to repay the loan amount with interest, as is mentioned in the judgment of the Co-operative Court. He, therefore, submits that this petition is rendered infructuous.

In the light of the above, the impugned show cause notice dated 07.03.2012 has merged in the proceedings before the Co-operative Court, with the judgment dated 06.02.2017 having been delivered.

Learned Counsel for the petitioner, therefore, submits that this petition can be disposed of as the petitioner intends to challenge the judgment of the Co-operative Court. 5.

Considering the above, this petition is disposed of as being infructuous.
