The respondent No.3 though served has not caused his appearance.

The present application is filed for condonation of delay of 193 days caused in filing the appeal. For the reasons stated in the application and more particularly the learned Advocate for the applicant submits that the applicants are poor agriculturists and their lands are compulsorily acquired for public project. The applicants have family problems. They are old persons and facing diseases. The

955 CA 10266-2023 appellants unable to file appeal in pandemic COVID-19. Therefore, delay is caused in filing the appeal.

In view of the same, the application for delay condonation is allowed and disposed of accordingly.

The appeal is admitted.

After admission of the appeal, the learned AGP waives service of notice on behalf of respondents-State.
