This is the Application for withdrawal of the balance amount, which is deposited by the Acquiring Body, i.e. Rs.31,95,963/- (Rupees Thirty Only Lakhs Ninety Five Thousand Nine Hundred Sixty Three). 2.

Heard the learned Advocate for the Applicant and the learned Advocate for the Acquiring Body.

There is no dispute that, the amount under Award is Rs.93,91,926/- . There is also no dispute that, the Applicant had withdrawn 50% of the amount under the Award, which was deposited before the learned Reference Court. It is further not in dispute that, subsequently, the Applicant withdrew Rs.15,00,000/- from the amount deposited by the Acquiring Body before this Court. The rate granted by the SLAO for the acquired land was Rs.3,700/- per R., and the Reference Court enhanced the same to Rs.24,000/- per R.

Considering all these aspects, the Applicant is permitted to withdraw Rs.10 Lakhs out of the remaining amount, along with the interest accrued thereon, on furnishing undertaking to the satisfaction of the learned Registrar (Judicial) of this Court.
